After filling out the required paperwork, file it with the court to start your divorce process.
A hearing will be scheduled on the next available date, or in some cases, you may “walk-in” the agreement and be heard before a judge on the same day (the former will generally be the case). In almost all cases, both parties must appear in court. The judge will review the agreement and confirm that the marriage has irretrievably broken down, and then a judgment nisi will be decreed after a waiting period of 30 days. After an additional 90 days of nisi period*, the results will become absolute, and the divorce is finalized.
*The nisi period is a mandatory waiting period between the time a judge grants a divorce and when the divorce is finalized. It is instated as a chance for divorcing parties to reconcile or prove that the agreement was signed based on fraudulent representations. No action needs to be taken by either party, but you will not be able to remarry within this period.
